TutorHub Terms of Service

1. Introduction

TutorHub ("we", "us", or "our") operates a platform that connects learners ("Students") with independent freelance tutors ("Tutors") for one-on-one online tutoring sessions. These Terms govern your use of the TutorHub platform and any related services (collectively, the "Services").

2. Eligibility

You must be at least 18 years old to use TutorHub. If you are between the ages of 13 and 17, you may use TutorHub only under the supervision of a parent or legal guardian, who will be fully responsible for all activities.

There are no geographic restrictions on who may use TutorHub.

3. User Accounts

Accounts are managed and secured through Clerk. By using our platform, you agree to comply with Clerk's terms of use and take full responsibility for maintaining the confidentiality of your credentials and account information.

You are responsible for all activity that occurs under your account. Please notify us immediately at support@tutorhub-edu.com if you suspect unauthorized use of your account.

4. Platform Use

• Students may use the platform solely for personal, non-commercial educational purposes.
• Tutors may use the platform solely to offer and provide tutoring services.
• All sessions must take place within the TutorHub platform. Tutors and Students may not circumvent the platform for direct payment or off-platform communication regarding services.
• You may not scrape, mine, or use automated tools to extract data from the platform without express permission.

5. Payments

All payments are securely processed through Stripe. TutorHub does not store or handle any credit card information.

Students pay for tutoring services through the platform. Payments made to TutorHub are considered full payment to the Tutor. Tutor payouts are made after deducting TutorHub's applicable service fees.

5.1 Tutor Commission

• TutorHub deducts 33% from the Tutor's earnings per lesson.
• This percentage may be reduced based on the Tutor's performance, including factors like lesson count, student retention, and student ratings.
• Performance-related commission changes are communicated transparently through the Tutor dashboard.

5.2 Trial Lessons

• Trial lessons are fully retained by TutorHub and are not paid to the Tutor.
• These lessons are part of our investment in marketing and student acquisition.
• The Tutor's responsibility is to deliver a high-quality trial and encourage the Student to purchase a package of lessons to begin structured learning.

6. Refunds

Refunds may be granted in limited circumstances and are issued at the sole discretion of TutorHub. Requests should be sent to support@tutorhub-edu.com.

7. Tutor Requirements

Tutors on TutorHub are independent freelancers. By using the platform as a Tutor, you agree that:

• You are solely responsible for the content of your profile and lessons.
• You will comply with all applicable laws and regulations in your jurisdiction.
• You will not offer or solicit payment outside of the platform.
• You grant TutorHub the right to display and promote your profile, image, and introductory video on the platform and in marketing materials.

8. Intellectual Property

You retain ownership of content you create, such as lesson materials. However, you grant TutorHub a limited, non-exclusive license to use, host, store, and display your content solely to provide the Services.

All other content on TutorHub (including branding, website design, and text) is the property of TutorHub and may not be reproduced without permission.

9. User Conduct

You agree to:

• Behave respectfully and professionally during all interactions.
• Not use the platform for illegal or unethical purposes.
• Not impersonate any person or misrepresent your identity or qualifications.

10. Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in inappropriate behavior, or attempt to bypass the platform's systems. You may also delete your account at any time.

11. Disclaimer of Warranties

TutorHub provides the platform "as is" without warranties of any kind, express or implied. We do not guarantee results from tutoring sessions or verify the credentials of Tutors beyond self-submitted profiles.

12. Limitation of Liability

To the fullest extent permitted by law, TutorHub shall not be liable for indirect, incidental, special, or consequential damages. Our total liability shall not exceed the amount you paid to us in the last three (3) months.

13. Dispute Resolution

Any disputes arising under these Terms will be governed by the laws of the jurisdiction in which TutorHub is registered (to be defined), and subject to binding arbitration.
